1. Acceptance of Terms

By accessing and using the valqerino.com platform, you agree to be bound by these Terms, our Privacy Policy, and our Cookie Policy. If you do not agree with any of these conditions, please refrain from using our services. Continued use of the platform after any modification to these Terms constitutes your acceptance thereof.

2. Description of Service

Valqerino operates a digital real estate crowdlending platform that allows users to collaboratively participate in development, renovation, and acquisition projects of real estate in the Dominican Republic. The platform acts as a technological intermediary, facilitating the connection between real estate project promoters and individuals interested in contributing capital.

Valqerino does not guarantee specific returns nor the recovery of contributed capital. All investment carries inherent risks that the user must evaluate independently.

3. Eligibility

To use Valqerino's services, you must: be over eighteen (18) years of age; have legal capacity to enter into binding contracts under Dominican law; provide truthful, complete, and up-to-date information during the registration process; and not be subject to legal restrictions that prevent you from participating in investment or crowdfunding activities.

4. Registration and User Account

Access to certain platform functionalities requires the creation of a user account. You are responsible for maintaining the confidentiality of your access credentials and all activities conducted under your account. You must immediately notify us of any unauthorized use of your account or any other security breach.

5. Informational Nature and Risks

The information published on the platform is informational in nature and does not constitute financial, legal, or tax advice. Projections, estimates, and data presented about projects are based on analyses performed at the time of publication and may vary.

Investments in real estate projects through crowdlending models carry risks, including the possible partial or total loss of invested capital. We recommend consulting with independent financial advisors before making investment decisions.

6. User Obligations

When using the platform, you agree to: use the services lawfully and in accordance with these Terms; not engage in fraudulent, deceptive activities or those that may harm other users or Valqerino; not attempt unauthorized access to platform systems or data; provide truthful and up-to-date information; and comply with all applicable laws and regulations, including anti-money laundering and counter-terrorism financing regulations.

7. Intellectual Property

All platform content, including texts, graphics, logos, images, software, and design, are the property of Valqerino S.R.L. or its licensors and are protected by the intellectual property laws of the Dominican Republic and applicable international treaties. Reproduction, distribution, or modification of any content without prior written authorization is prohibited.

8. Limitation of Liability

To the maximum extent permitted by law, Valqerino shall not be liable for: indirect, incidental, special, or consequential damages arising from use of the platform; financial losses resulting from investment decisions made based on published information; interruptions or errors in platform operation; nor for actions or omissions of third parties, including project promoters.

Valqerino evaluates published projects but does not guarantee their success nor the accuracy of all information provided by promoters.

9. Applicable Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Dominican Republic. Any dispute arising from the use of the platform or the interpretation of these Terms shall be submitted to the exclusive jurisdiction of the competent courts of the National District of Santo Domingo, Dominican Republic.

10. Modifications

Valqerino reserves the right to modify these Terms at any time. Modifications will take effect from their publication on the platform. In the case of substantial changes, registered users will be notified at least fifteen (15) days in advance by email or by notice on the platform.

11. Termination

Valqerino may suspend or cancel your access to the platform in case of breach of these Terms, fraudulent conduct, or any activity that harms the operation of the platform or the rights of other users. You may cancel your account at any time by contacting us through the indicated channels.
